Dems agree to limit abortion coverage in health-care bill
http://www.mcclatchydc.com/251/story/78515.html
Nov. 7, 2009
40 anti-abortion Democrats signaled they might oppose the bill if its current provisions remained [that] allowed insurers to separate public and private funds, permitting only the privately collected money to be used for elective abortions. Public money could have been used only for abortions that result from rape or incest or threaten the life of the mother... federal law since the mid-1970s. But anti-abortion Democrats objected that the bill still would provide a federal subsidy for insurance plans that allowed abortion. After days of tense talks, they reached agreement early Saturday with Democratic leaders and the White House on an amendment that would refuse abortion coverage to anyone who receives federal aid to buy an insurance policy or enrolls in the proposed government health plan. The segregated accounts would be gone, though anyone could buy private policies covering abortions using their own funds. Representatives of the U.S. Conference of Catholic Bishops were involved in the talks.

Christian Soldiers: The growing controversy over military chaplains using the armed forces to spread the Word.
Kathryn Joyce, June 19, 2009, http://www.newsweek.com/id/202734
Ever since former president George W. Bushreferred to the war on terror as a “crusade” in the days after the September 11 attacks, many have charged that the United States was conducting a holy war, pitting a Christian America against the Muslim world. That perception grew as prominent military leaders such as Lt. Gen. William Boykin described the wars in evangelical terms, casting the U.S. military as the "army of God."...

U.S. Occupation Force Troops in Iraq, Afghanistan Get Bibles on a Stick
BibleSticks are digital audio bibles, carrying the Audio Drama version of the new testament, designed to be small, easy to carry, and to appeal to the "iPod generation." ... designed to be low-visibility so, you know, your bible doesn't get you shot (unlike that bright white iRosary )... Faith Comes by Hearing's national director Troy Carl notes the devices have received a "tremendous response", more than 200 chaplains across the different military services are using the BibleSticks as part of their ministrations.... One Army chaplain, referring to the BibleSticks, noted how fabulous it was that the soldiers are now "able to listen to the Word of God while doing missions.".. The image of a disturbed troop, all crazied-up in battle, marching along with a gun, the bible ringing in his ears and wreaking biblical vengeance is a pretty *uncomfortable one. http://www.fastcompany.com/blog/kit-eaton/technomix/us-troops-iraq-afgha... http://snipurl.com/t28hg

Shooting reveals tensions over Muslims in the military
http://www.mcclatchydc.com/251/story/78511.html
..."They're trying so hard to pin this on Islam," said Arshad Qureshi, the mosque chairman. "They're working so hard to make it about religion."
Muslims make up less than 0.3 percent of America's active duty military forces. Of the roughly 548,000 soldiers in the U.S. Army, there are 2,500 Muslims, 1,500 of them on active duty. By comparison, 105,000 claim Roman Catholicism as their religion, and 99,000 say they're Baptists. More than 1,800 soldiers say they're Jewish, surpassed by the nearly 2,500 who identified themselves as atheists. More than 101,000 list no religious affiliation. That was the case with Hasan, according to Pentagon officials, even though interviews at the Silver Spring mosque make it clear that he was an observant Muslim who prayed daily — often in uniform... Hasan's religious affiliation was known to his military colleagues, and may have caused tensions.
Hasan's family said that he was harassed for his faith and the Washington Post quoted his aunt Friday as saying Hasan had sought legal help in an effort to get out of the Army....
At the Muslim Community Center where Hasan prayed for five years, congregants, the imam and board members were deluged Friday with different versions of the same question."Does Islam condone this? Qureshi, the mosque's chairman, spent Friday morning and most of the afternoon telling reporters that Islam is a religion of peace...."I ask the media people not to relate all the time everything to Islam," he said over loudspeakers...

Army Tests Sole-Killer Theory as Details Emerge
http://www.nytimes.com/2009/11/07/us/07forthood.html?ref=us&pagewanted=a...
...military and federal investigators pointedly refuse to release further details on how the shootings happened, why there were initial reports of multiple attackers and why officials took several hours to correct news media reports that Major Hasan had been killed. Most significant, officials were not prepared to say whether the attack was the act of a lone and troubled man or connected to terrorist groups, foreign or domestic....
In Washington, a law enforcement official said an early search of Major Hasan’s computer did not indicate any direct exchanges with known terrorists. The official said investigators did not have a complete record of Major Hasan’s Internet use, as he had multiple e-mail accounts and used computers in several locations. The Federal Bureau of Investigation became aware earlier this year of Internet postings by a man calling himself Nidal Hasan. The postings drew attention because they favorably discussed suicide bombings. But the investigators are still not clear as to whether the writer was Major Hasan...
Two students in the [master's degree public health] fellowship program said Major Hasan had sat alone in the front of the class and rarely socialized with other students, other than to debate the wars in Iraq and Afghanistan. He made clear he strongly opposed both, the former students said.

Major Hasan also told family members that he had experienced anti-Muslim harassment in the Army and had tried for several years to be discharged. But the Army, which had paid for his education and was in great need of psychiatrists, refused, family members said. “Just recently, we received phone calls from the family, saying that Nidal was unhappy because he had big problems at work,” said Mohammed Mohammed, a cousin of Major Hasan’s from Ramallah on the West Bank. In an interview at their home there, Mr. Mohammed and another cousin, Mohammed Hasan, said they had kept up with Major Hasan’s situation through his brother Anas, a lawyer who recently moved to Ramallah. Major Hasan’s family in Virginia said he had been afraid of deploying because he had heard the horrors of war from returning soldiers. But the cousins in Ramallah offered another reason: he was soon to be wed and did not want to leave his spouse. ..
In an interview on NBC’s “Today” show, Lt. Gen. Robert W. Cone, the Fort Hood commander, was asked about reports that before opening fire, Major Hasan had yelled “Allahu akbar!” — “God is great!” General Cone said soldiers at the scene had reported “similar” accounts. Muslims who attended mosques with Major Hasan in Virginia, Maryland and Texas said they had never heard him express extremist views about politics or religion. And though openly opposed to the wars, he did not express anti-American sentiments, they said....

President Obama called it “a horrific outburst of violence... horrifying that they should come under fire at an Army base on American soil”...

"...Officials are not ruling out the possibility that some of the casualties may have been victims of "friendly fire," that... some of the responding military officials may have shot some of the victims... In an interview with The Washington Post, Hasan's aunt, Noel Hasan said he had been harassed about being a Muslim in the years after the Sept. 11, 2001, terror attacks, and he wanted out of the Army....At least six months ago, Hasan [NB reported as if it's the same man -- and a fact] came to the attention of law enforcement officials because of Internet postings about suicide bombings and other threats, including posts that equated suicide bombers to soldiers who throw themselves on a grenade to save the lives of their comrades. Investigators had not determined for certain whether Hasan was the author of the posting, and a formal investigation had not been opened before the shooting, said law enforcement officials who spoke on condition of anonymity because they are not authorized to discuss the case. http://www.adn.com/nation/story/1001657.html

Into the Dark: The Pentagon P20G Plan to Provoke Terrorist Attacks

... in last Sunday's Los Angeles Times. There--in an article by military analyst William Arkin, detailing the vast expansion of the secret armies being amassed...came the revelation of Rumsfeld's plan to create "a super-Intelligence Support Activity" that will "bring together CIA and military covert action, information warfare, intelligence, and cover and deception." According to a classified document prepared for Rumsfeld by his Defense Science Board, the new organization--the "Proactive, Preemptive Operations Group (P2OG)"--will carry out secret missions designed to "stimulate reactions" among terrorist groups, provoking them into committing violent acts which would then expose them to "counterattack" by U.S. forces. What kind of measures exactly? Well, the classified Pentagon program puts it this way: [...]

False Flag Prospects, 2008 -- Top Three US Target Cities
by Captain Eric H. May
The easiest way to carry out a false flag attack is by setting up a military exercise that simulates the very attack you want to carry out. As I'll detail below, this is exactly how government perpetrators In the US and UK handled the 9/11 and 7/7 "terror" attacks, which were in reality government attacks blamed on "terrorists."
My aim, as a former military intelligence officer who spent five years with the U.S. Army 75th Division conducting military war games, is to convince the American people that the "next 9/11" -- constantly promised by officials and the media -- is likely to be carried out under the guise of future military exercises. If the American people are aware of pending exercises and the danger they represent, then the exercises cannot "go live" and effect the very terror events that they are supposed to be rehearsing against.[...]

IMPERIALIST 'COLLATERAL DAMAGE'
Dark Glass: Hateful Echoes and Hidden Costs
Chris Floyd
At this stage, with so much about the Ft. Hood case still unknown, there is little point in commenting on the substance of the case. But all kinds of rumors and conjectures and second-hand reports about the alleged shooter are richoceting around the media echo chamber. For example, the New York Times...filled early reports with pro-terrorist comments culled from the internet, left there by people who have the same or similar names as the accused... The fact that it is unlikely that an Army officer on active duty would post such comments in his own name was obviously no bar to getting the most the most inflammatory factoids into circulation as soon as possible. This might be considered irresponsible, if it didn't come from a paper that has been instrumental in selling the Terror War, with its ever-mounting toll of civilians deaths (three more children, and other civilians working in a field, were killed by a NATO missile on the same day of the Ft. Hood shooting), and all the despair and suffering and hatred it is engendering. In any case, at this point, I think the only relevant thing one can say about this particular case appeared on the website of the Iraq Veterans Against the War on Thursday: "The shootings that happened today are a tragic reminder of the hidden costs of war."...
The entire lexicon of Islamophobia is already filled to bursting with Nazi tropes – "the enemy within," the dark, monolithic mass of "prodigious breeders" threatening to overwhelm Western Civilization, the "maniacal extremists" who will not rest until they destroy the sacred Homeland, the sinister, secret worldwide conspiracy which bribes and suborns Western leaders into doing its bidding, etc. etc. This sinister discourse is accepted, and used, among the highest circles of power – senators, representatives, "serious" commentators, academics, think-tank apparatchiks. And all of this is being constantly regurgitated even while the armed forces and covert operators of the United States are in the midst of an apparently endless campaign of death and violence that has killed, so far, well in excess of a million innocent people – the vast majority of them Muslims, or of Muslim heritage – while planting great, bristling fortresses of domination and excess...

Fort Hood Shootings: Don't Let Racism Hide Truth
RedBedHead
The wars in Iraq and Afghanistan have led to the slaughter of hundreds of thousands of innocents and the destruction of infrastructure and social networks that will take generations to repair. The media and government are utter, utter hypocrites to condemn these murders while taking no note - or reporting as simply normal operation procedure - the families slaughtered wholesale by US drones that fire missiles at wedding and funeral parties, into Pakistani villages. In Afghanistan alone there have been an estimated 8,400 - 28,000 direct and indirect civilian deaths caused by ISAF and US forces....
The sheer racism involved in immediately speculating on the religion of the shooter. Back in May, an Army Sgt. stationed in Iraq and suffering from PTSD shot and killed five of his fellow soldiers. That man's name - John Russell - was Anglo Saxon. Nobody speculated on the role of his religion in the killing. In this instance, as an article in the New York Times makes clear, Hasan, who joined the military out of patriotism, faced harassment for being Muslim and wanted out, even pursuing a failed legal route to early discharge. As a psychiatrist, he had counseled many returning vets who suffered PTSD. The combination of these two things apparently made him "mortified" at the prospect of being sent to Iraq or Afghanistan.
This racism also provides a cover for the fact that men and women trained to kill and who experience the brutality of enforcing occupations in Afghanistan and Iraq, suffer from mental breakdowns, suicides and commit murders at far higher rates than the general population [2007 CBS News investigation] ...And according to an article in the Washington Post, based in part upon an investigation by the Colorado Springs Newspaper, the rate of homicides amongst veterans from the Fourth Infantry Division's Fourth Brigade were 114 times higher than the rate amongst the general population in Colorado Springs, where they are stationed stateside. "During their deployment, some soldiers killed civilians at random -- in some cases at point-blank range -- used banned stun guns on captives, pushed people off bridges, loaded weapons with illegal hollow-point bullets, abused drugs and occasionally mutilated the bodies of Iraqis, according to accounts the Gazette attributed to soldiers who said they witnessed the events."
Another study by the New York Times found that at least 120 people had been killed by returning vets. However, the Times itself assumes that this is a conservative number since it was reached only by looking at newspaper reports and it only includes active-duty soldiers and new veterans. The CBS survey used government statistics.

Mass murder has become as American as apple pie with dozens killed in spree murders this year alone. What is it about American society that brings about such a large number of these types of violent acts? The roots have to be found in the fact that America is the world's biggest, most violent empire, whose means of domination and largest single budget outlay goes towards the
military. This year alone the military will take up to $700 billion directly with more indirectly through military aid to countries such as Israel and Colombia. This is a country jacked on violence. America, as the wealthiest nation on earth, also had the third highest levels of inequality and poverty in a study by the OECD released in 2008. The only two countries above the US were Turkey and Mexico. The combination of poverty and glorified violence, in the shadow of historically unprecedented levels of wealth creation is key to understanding the prevalence of violence in America. www.uruknet.info?p=5978

Easy Out to Avoid the Deeper Reasons for the Massacre
Mark Ames
http://www.uruknet.de/pic.php?f=6fhr4183108586.jpg
It’s hard to pinpoint what’s the most shocking thing about Major Malik Nadal Hasan’s shooting rampage in Fort Hood, Texas. I’ll start with this: there’s nothing all that ground-breaking about it. Happens all the time, it’s just that we’re a nation of amnesiacs who forget all the unpleasantries, and refuse to learn the valuable lessons. For starters, Fort Hood is located in Killeen, Texas -- where one of the deadliest rampage shootings in American history took place in 1991, when an unemployed ex-Navy enlistee, George Hennard Jr. crashed his pickup into a popular cafeteria, pulled out two handguns ...and murdered 23 people before taking his own life. The day before the massacre, Hennard was eating a hamburger in a local restaurant watching the Clarence Thomas confirmation hearings and, according to the manager "When an interview with Anita Hill came on, he just went off. He started screaming, 'You dumb bitch! You bastards opened the door for all the women!'"
So yesterday’s Fort Hood shooting isn’t the worst or most deranged mass-killing in Killeen’s history -- not by a longshot. The mainstream media is enabling the screaming about the Muslim traitors in our midst, but Hasan killed far fewer Americans than the white, racist George Hennard. And they were bested by the federal government in nearby Waco Texas, in 1993, when federal forces slaughtered some 75 men, women and children in the Branch Davidian compound.
But in what may seem like a strange coincidence, Maj. Hasan and Killeen are connected to another American shooting rampage. Killeen held the record for America’s worst shooting massacre until 2007, when Virginia Tech student Seung-Hui Cho shot and killed 33 fellow students And Malik Nadal Hasan graduated from Virginia Tech in 1997. Both Hasan and Cho were bullied and harassed -- Hasan’s cousin told reporters that after 9/11, his military comrades regularly abused him, calling him "camel jockey." But the cousin insisted that Hasan’s opposition to the war didn’t grow out of the bullying, but from the stories he heard interning as a psychiatric counselor to veterans from the Iraq and Afghanistan wars. Hasan even hired an attorney to try to come to a settlement with the US government and leave the service, but they wouldn’t settle for a deal and instead forced him to deploy. He apparently fought it up to the day before his deployment -- and instead of going to the war, he brought the war to the US military...

Hasan, whose parents came to the US from Palestine, had plenty of personal connections to "Made in the USA" violence and massacres; and yet there’s a frantic attempt to make him out to be a crazy Muslim monster hell-bent on killing Americans. Why would he need to take inspiration just from them, when Americans already provided so many excellent examples of how to mass-murder fellow Americans? Fort Hood, the largest military base in America, has seen its share of violence as well. For one thing, it holds the record for most soldiers killed in Iraq and Afghanistan -- 685 so far -- and though we don’t know the figures, it’s reasonable to assume that Fort Hood is responsible for a sizable percentage of the tens or hundreds of thousands killed in those countries since America invaded them.
Over the same period, 75 soldiers committed suicide at Fort Hood, ten in 2009 alone -- the highest of any base. In just one weekend in 2005, two soldiers who’d returned from Iraq killed themselves in separate incidents. Last year, in something right out of Full Metal Jacket, Specialist Jody Michael Wirawan, 21, of the 1st Cavalry Division, shot and killed his lieutenant then killed himself when police arrived. And life in Killeen isn’t much nicer : it has one of the nation’s lowest median incomes and highest crime rates. Earlier this year, a 20-year-old Fort Hood soldier was killed by a Killeen cop who claimed he killed the soldier after being dragged underneath his SUV; the dead soldier’s mother filed a lawsuit claiming that the cop was notoriously out-of-control and violent, and that he shot her son while the car was pulled over. All this violence and despair led Fort Hood’s commander, Lt. General Rick Lynch, to build a post-traumatic stress disorder complex called the Resiliency Campus, featuring a Spiritual Fitness Center for soldiers to meditate, and a Cognitive Enhancement Assistance Center. As though a spiritual fitness workout routine could resolve the underlying cause of why a Resiliency Campus was built in the first place...
And he’s not the first soldier at Fort Hood to protest the war. Desertion rates have soared since the Iraq invasion, and Fort Hood has had some high-profile objectors making the news this year, such as Spc. Victor Agosto, who was court-martialed in August after he refused to go to Afghanistan, and Sgt. Travis Bishop, who filed for conscientious objector status after serving in Iraq for 14 months.

Going back to [the] Vietnam War, Fort Hood was famous as the site of one of the first anti-war protests in 1965, when the so-called "Fort Hood 3" refused to be shipped off on the grounds that the war was wrong and illegal. Three years later, the movement expanded: hundreds of African-American GIs protested plans to deploy them to the 1968 Democratic Convention in Chicago, and 43 were court-martialed. It was a heroic act: US troops and cops staged one of the bloodiest police-on-citizen episodes in modern history. In 1971, the Fort Hood United Front, made up of soldiers from the base, marched into Killeen, even though the city refused to grant them a permit; hundreds were arrested.  Today, if you read through some of the forums out of Fort Hood, the antiwar mood is clearly strong and clearly a problem for the authorities. So they’ll do their best to paint Maj. Hasan as a Muslim loon...to equate opposition to the wars with pro-terrorist, anti-American [ed: author also equates "pro-terrorist, anti-American"] sentiment, and by the poll numbers today, that would make most Americans anti-American terrorists.

Nullification of justice: manufacturing guilt and public opinion
Details emerge about Fort Hood suspect's history
..."He swore an oath of loyalty to the military," Dr. Grieger said. "I didn't hear anything contrary to those oaths."
But, more recently, federal agents grew suspicious. At least six months ago, Hasan came to the attention of law enforcement officials because of Internet postings about suicide bombings and other threats, including posts that equated suicide bombers to soldiers who throw themselves on a grenade to save the lives of their comrades. They had not confirmed Hasan is the author of the posting, and a formal investigation had not been opened before the shooting, said law enforcement officials who spoke on condition of anonymity because they are not authorized to discuss the case.... http://seattletimes.nwsource.com/html/politics/2010214367_apusforthoodsh...

...Seattle detectives were pursuing a tip in the case Friday at an apartment complex in the south Seattle suburb of Tukwila, Tukwila police spokesman Mike Murphy said. Television footage showed dozens of cruisers surrounding the building, while officers examined a car that, though covered by a tarp, resembled the profile of a vehicle seen nearby when the officer was killed....A citizen told authorities about the car, Murphy said....the person of interest, not yet named by authorities, was 41 and had been shot in the head, according to The Seattle Times.. just as a memorial service for Brenton had finished at Seattle's KeyArena. Thousands of officers from around the country attended the memorial.

Detectives have said they are looking into a possible connection between Brenton's killing and the Oct. 22 firebombings of three Seattle police cruisers and a mobile command post at a nearby city garage. Investigators reportedly found a note threatening to kill officers and fliers protesting police brutality at the arson scene.

Flags were key link to cop slaying, bombings
An American flag left at the scene of Officer Timothy Brenton's slaying on Halloween and at a city maintenance yard where four police vehicles were torched on Oct. 22 gave investigators a key link between the two crimes even before a Tukwila man was identified as the suspect. Detectives are now trying to determine why the man suspected of both crimes, Christopher John Monfort, 41, held a grudge against police that went from destructive to lethal in the span of nine days....
A search of Monfort's apartment this morning turned up evidence that police say connects the man to the Oct. 22 bombing and arson of the maintenance yard, where three police cars and an RV used as a mobile precinct were damaged, according to Assistant Seattle Police Chief Jim Pugel. A note threatening to kill police officers was left at the bombing site, sources had said earlier. Pugel said an item found at the maintenance yard was similar to one found near the shooting scene. Law-enforcement sources said the item was an American flag....
Pugel said this morning police also found two rifles in the apartment, including a "military-style assault rifle" being examined as the possible weapon used to kill Brenton. Pugel also said they found improvised explosive devices which police had to disarm before removing. Two cars belonging to the suspect have been impounded, but not yet searched. During a news conference this morning, Pugel called the two crimes "domestic terrorism."

News reports at the time said fliers were left at the maintenance yard referring to an anti-police-brutality rally and citing the case of a King County sheriff's deputy accused of assaulting a teenage girl in a SeaTac holding cell [graphic video of cops viciously kicking and beating her was briefly shown on local news]

THE 'LONE TERRORIST'...
Last year, Monfort belonged to the McNair Scholars Program, part of the university's office of Minority Affairs and Diversity. The program aims to steep undergraduate students in sophisticated research, preparing them for graduate work. Monfort provided this title for his project with the McNair program: "The Power of Citizenship Your Government Doesn't Want You to Know About: How to Change the Inequity of the Criminal Justice System Immediately, Through Active Citizen Nullification of Laws, As a Juror."
Monfort received a bachelor's degree from the UW in March 2008, according to the university's degree-validation Web site. His major was in Law, Societies and Justice. In an abstract of his project, Monfort said he planned to "illuminate and further" the scholarship of Paul Butler, a law professor at George Washington University. Butler is a proponent of jury nullification, a * controversial principle whereby jurors feel free to disregard a judge's instructions and acquit a defendant no matter the strength of the evidence. Butler has argued that such nullification may be particularly appropriate in cases where black defendants are charged with nonviolent crimes. "It is the moral responsibility of black jurors to emancipate some guilty black outlaws," Butler wrote in a 1995 Yale Law Journal article, adding: "My goal is the subversion of American criminal justice, at least as it now exists." In a McNair program newsletter, Monfort said he had previously been a student at Highline Community College, where he was "inspired" by Garry Wegner, who was the school's program coordinator for the Administration of Justice program. Wegner said Friday that Monfort fared poorly the first time he attended the college. But he later returned to the Des Moines school and "caught fire academically." "He did very, very well interacting with the other students in my class," said Wegner, who spent 20 years as the deputy director of the Washington State Criminal Justice Training Commission that trains many of the state's law enforcement officers. "He always seemed to be a natural leader, and people would gravitate to him. He put in a lot of work and did well academically. He said it was because he finally found something that interested him — the field of criminal justice." Wegner, who described Monfort as "a mature, stable individual," said he was shocked to hear that his former student is the suspect in Brenton's slaying. "You've shaken me to my toes," he told a Times reporter...
During his last year at Highline, Monfort became involved in student government and was elected vice president of legislation The Oct. 23, 2003, edition of a Highline publication, The Thunderword, describes how Monfort ran for the school's student senate and spoke at a candidates' forum. "Too often, too many of us walk around with our head in the clouds," Monfort said at the forum, according to the article....Monfort "believes he is unique, because he is upset about our current state of government
and actually wants to do something about it. ... The student body has been cheated and lied to by the Bush Administration, said Monfort. He plans on putting together a petition to bring our soldiers home." The article quoted Monfort saying: "Our freedom is under attack." ...

* JURY NULLIFICATION -- based on Jeffersonian belief in potential of capitalist criminal justice system
Justice Often Served By Jury Nullification
http://www.foxnews.com/story/0,2933,163877,00.html
...Here in America, the Founding Fathers understood the importance of allowing juries to determine not just the guilt or innocence of the man on trial, but the justice and fairness of the law he's charged with breaking. John Adams said of jury nullification, "It is not only [the juror's] right, but his duty...to find the verdict according to his own best understanding, judgment, and conscience, though in direct opposition to the direction of the court." John Jay, the first chief justice of the Supreme Court, said "The jury has the right to judge both the law as well as the fact in controversy."
In recent times, the doctrine has become almost obsolete. Judges routinely instruct jurors that they are not to determine the justness of the law in question, only whether the defendant is guilty of breaking it. This is simply not true. In the Rosenthal case, the judge actually cut off the defense lawyer when he hinted in his closing remarks that the jury had the power to acquit Rosenthal regardless of the evidence against him.
So why do judges continue to get jury nullification wrong? Many point to an 1895 case in which the Supreme Court ruled that judges aren't obligated to tell jurors of their power to nullify bad law. Some have wrongly interpreted that decision to invalidate the doctrine of jury nullification altogether. They're mistaken.
In fact, the Supreme Court has since repeatedly upheld the doctrine of nullification. In 1952, for example, the Court found that "juries are not bound by what seems inescapable logic to judges." And in 1972, that "The pages of history shine on instances of the jury's exercise of its prerogative to disregard instructions of the judge."...
There are multiple cases of jurors refusing to convict violators of the Alien and Sedition Act (search ), the Fugitive Slave Act (search ), and alcohol prohibition laws, among others....

Jury Nullification
DEFINITIONS
http://www.crfc.org/americanjury/lessons/nullification/definitions.html
"Jury nullification occurs when guilt is established but the jury decides to acquit on its own sense of fairness, propriety, prejudice, or any other sentiment or concern." Randall Kennedy, Race, Crime, and the Law (1997)
"True" or stringent nullification "occurs when the jury recognizes that a defendant's act is proscribed by the law but acquits because it does not believe the act should be proscribed. The behavior, in other words, is not criminal in the eyes of the jury."
"Intermediate" nullification occurs when "although the act proved is properly classified as criminal, it is within a class of acts that do not deserve the punishment prescribed for them."
"Weak" or "ad hoc" nullification "reflects the jury's view that although the act proved is criminal and falls in a class of acts that may well deserve the prescribed punishment, such punishment is inappropriate in the case at hand." Thomas Andrew Green, Verdict According to Conscience (1985)
