Senate Democrats Unveil Immigration Proposal

Several Senate Democrats unveiled their immigration overhaul proposal Thursday. The first thing to say about it is that it is proof that lawmakers have learned the lessons of the failed efforts of 2006 and 2007 to achieve a comprehensive immigration fix. After a popular backlash torpedoed President George W. Bush's push for an overhaul, the Democrats have decided that the only way to get political support for making the kind of broad-based immigration changes they seek is to deal with the border enforcement end of the issue first....
Senate Democrats also want a secure Social Security card containing biometric information that would be necessary for employment. And in a kind of Orwellian touch, they propose the creation of a new data system called the Biometric Enrollment, Locally-stored Information, and Electronic Verification of Employment or BELIEVE.
The acronym of this system appears to be an appeal to Americans to suspend the cynicism born of the flawed implementation of the 1986 immigration law changes which gave legal status to millions of illegal immigrants but never delivered on promises of enforcement. It is the politicians' cry for voters to put their faith in the new system and proposal....
It being an election year, the smart money in Washington is betting that the Senate Democrats' proposal won't go anywhere this year. But it will allow Democrats to claim the higher ground in contrast to the new Arizona law that cracks down on illegal immigrants. And it also allows Democrats to rally Hispanic voters in what is otherwise expected to be a very difficult mid-term election year for Congress' majority party.

WASHINGTON : A video allegedly from a Pakistani Taliban group, Tehreek-e-Taliban, claimed responsibility for the New York car bomb attempt, the SITE monitoring service said Sunday, although the claim's credibility has been questioned....SITE said the video contained an audio message from Qari Hussein Mehsud, a Tehreek-e-Taliban official, that was played over anti-American images with English subtitles....Posted on YouTube, instead of the password protected websites where other Jihadist announcements are made, the video said the attempted bombing was in revenge for the recent killing of two, top Al-Qaeda leaders in Iraq, US drone strikes in Pakistan and US treatment of a Pakistani neuroscientist, SITE said...

Top federal law enforcement and intelligence officials — Obama's national security adviser James Jones, national intelligence director Dennis Blair, CIA chief Leon Panetta, Napolitano and Attorney General Eric Holder — planned to participate in a meeting later Sunday on the bomb. The latest terror threat in New York came last fall when air shuttle driver Najibullah Zazi admitted to a foiled homemade bomb plot aimed at the city subway system. Officials said the device found Saturday was crudely constructed, but Islamic militants have used propane and compressed gas for years to enhance the force of explosives. Those instances include the 1983 suicide attack on the U.S. Marines barracks at the Beirut airport that killed 241 U.S. service members, and the 2007 attack on the international airport in Glasgow, Scotland. In 2007, the U.S. military announced that an al-Qaida front group was using propane to rig car bombs in Iraq.

Federal law already requires aliens to register and carry their documents with them. The new Arizona law simply does the same thing. Because illegal immigrants are by definition in violation of federal immigration laws, they can now be arrested.

The national ID program would be titled the Believe System, an acronym for Biometric Enrollment, Locally stored Information and Electronic Verification of Employment. It would require all workers across the nation to carry a card with a digital encryption key that would have to match work authorization databases. “The cardholder’s identity will be verified by matching the biometric identifier stored within the microprocessing chip on the card to the identifier provided by the cardholder that shall be read by the scanner used by the employer,” states the Democratic legislative proposal.

Democrats Outline Plans for Immigration
The outline for an immigration overhaul unveiled by Democratic senators this week lays down a new starting point for any national debate: tough immigration enforcement. But perhaps more significantly it reveals how politics have shifted on the contentious issue. The enforcement would be more far-reaching than anything in place now — or anything proposed by the administration of President George W. Bush....
Democrats have joined Republicans in seeking to avoid the mistakes of 1986, when the last major overhaul gave amnesty to more than three million illegal immigrants, but enforcement provisions were largely left out of the final legislation....
The blueprint, written primarily by Mr. Schumer, includes a proposal for a Social Security card containing a biometric chip that all workers, including American citizens, would have to present to an employer when being hired. The proposal was presented by Mr. Schumer, Mr. Reid, Senator Robert Menendez of New Jersey, Dianne Feinstein of California and Richard J. Durbin of Illinois. Employers would be responsible for monitoring the immigration status of potential hires much more closely than they do now. Every employer would be required to use a new verification system, including a scanner at every business to confirm the validity of the Social Security cards of job applicants. Conservatives, while supporting stronger enforcement, have long opposed national identity cards, or making the Social Security card a de facto one...
As part of the enforcement system, the outline calls for a national system to register births and deaths, to eliminate the fraudulent use by immigrants of documents of people who have died. It would establish a system to monitor the departure of all immigrants as well as their entry into the country. If immigrants failed to leave when their visas expired, the immigration authorities would be required to deport them quickly. Immigration officials have said that creating an exit system would be a vast task that could take many years to complete.
The proposal opens the door wider than ever before to high-skilled immigrants. It would offer permanent-resident status, with a document known as a green card, to every foreigner with an advanced degree in science or technology from an American university. It would make it much easier for foreign students in the sciences to stay in the United States after they graduate, and eliminate numerical restrictions that have kept highly educated immigrants from India and China waiting for many years before becoming residents....

In March 2010 Mr. Schumer and Senator Lindsey Graham, Republican of South Carolina, unveiled the outlines of a reform proposal, which would require illegal immigrants to admit they broke the law before they could gain legal status and require all workers in the United States to carry a biometric identity card to prove that they are eligible to work. President Obama immediately responded with a statement saying it "should be the basis for moving forward."...
IMMIGRATION UNDER THE OBAMA ADMINISTRATION... despite early pledges that it would moderate the Bush administration's tough policies, the Obama administration is pursuing an aggressive strategy for an illegal-immigration crackdown that relies significantly on programs started by his predecessor...In broad outlines, officials said, the Obama administration favors legislation that would bring illegal immigrants into the legal system by recognizing that they violated the law, and imposing fines and other penalties to fit the offense. The legislation would seek to prevent future illegal immigration by strengthening border enforcement and cracking down on employers who hire illegal immigrants, while creating a national system for verifying the legal immigration status of new workers... administration officials argue that no-nonsense immigration enforcement is necessary to persuade American voters to accept legislation that would give legal status to millions of illegal immigrants, a measure they say Mr. Obama still hopes to advance late this year or early next. That approach brought Mr. Obama around to the position that his Republican rival, Senator McCain, espoused during the 2008 presidential campaign, a stance Mr. Obama rejected then as too hard on Latino and immigrant communities.
In carefully choreographed moves, Senators Schumer and Graham described their proposal in an editorial posted on March 18 on the Web site of The Washington Post. The plan calls for a big increase in immigration agents patrolling workplaces, and would require all workers, including legal immigrants and American citizens, to present a tamper-proof Social Security card when they apply for jobs. Biometric identity information would be stored on the card and not in any government database, according to an explanatory document from the senators.
The plan's emphasis is on making it easier for highly skilled and educated immigrants to come to the United States, including awarding residence documents known as green cards to those who receive advanced degrees in science and technology from American universities. It proposes a limited program for temporary lower-skilled guest workers, tightly keyed to changes in the American labor market. To gain legal status, illegal immigrants would have to admit their legal violation, pay fines and back taxes and perform community service.

International Workers Day
International Workers' Day (used interchangeably with May Day) is a celebration of the social and economic achievements of the international labor movement and left-wing movements. May Day commonly sees organized street demonstrations and street marches by millions of working people... throughout most of the countries of the world — although relatively rarely in the United States... The United States has its own Labor Day holiday, celebrated on the first Monday in September instead of on May Day...adopted officially in 1887 in an effort to disassociate labor activism from the radical left. Subsequent efforts to officially switch Labor Day to the international date of May 1 have failed. In 1921, following the Russian Revolution of 1917, May 1 was promoted as "Americanization Day", as a counter to the Communists, by the Veterans of Foreign Wars and other groups. It became an annual event, sometimes featuring large rallies. In 1949, Americanization Day was renamed to Loyalty Day. In 1958, Congress declared Loyalty Day a national holiday; that same year, U.S. President Dwight D. Eisenhower proclaimed May 1 Law Day as well.

Despite the prevailing sentiment for observance of Labor Day in September, some unions and union locals in the United States — especially in urban areas with strong support for organized labor — have attempted to maintain a connection with more radical labor traditions through their own unofficial observances on May 1. Some of the largest examples of this occurred during the Great Depression of the 1930s when thousands of leftist workers marched in May Day parades in New York's Union Square. Smaller far left groups have also tried to keep the May Day tradition alive with more radical demonstrations in such cities as New York and Seattle, without major union backing.

In 2006, May 1 was chosen by mostly Latino immigrant groups in the U.S. as the day for the Great American Boycott, a general strike of illegal immigrant [SIC] workers and supporters to protest H.R. 4437, immigration reform legislation... calling for immigrant rights, workers rights and amnesty for undocumented workers...the strike actions timed to coincide with International Workers' Day. On May 1, 2007, a mostly peaceful demonstration in Los Angeles in support of illegal [SIC] immigrant workers ended with a widely televised assault by LAPD officers.

People across the world have taken to the streets to mark international Labor Day In Greece, tens of thousands of furious demonstrators denounced planned austerity measures needed to secure rescue loans for the country... Police clashed with protesters in Athens and in the second-largest city of Thessaloniki...as Greek officials today wrap up negotiations with the European Union and the International Monetary Fund to dramatically cut spending and raise taxes in return for the international loan package, worth $60 billion this year alone. The austerity measures, which will include freezing pensions and wages, have met fierce resistance in Greece. A nationwide general strike is expected on May 5 ....

In 2006, millions were involved in protests over a proposed reform to U.S. immigration policy. The protests began in response to proposed legislation known as H.R. 4437, which would raise penalties for illegal immigration and classify unauthorized immigrants and anyone who helped them enter or remain in the US as felons.

They also protested a proposed congressional bill that would declare undocumented workers to be felons and charge anyone helping them find jobs or housing with a crime....

New York City - A march of over 200,000 people began in Chinatown, rallied in Union Square Park, continued down Broadway to Federal Plaza, led by a diverse coalition of workers' and immigrants' organizations.
The Great American Boycott of 2006 galvanized the sentiments of millions of people living in the United States both legally and illegally and highlighted the extremely emotional issue of illegal immigration in America, motivating thousands to join demonstrations in protest of a new stricter immigration policy as well as invoking intense debate on all sides of the political spectrum.[70] On May 15, 2006, President Bush announced plans for the Pentagon to deploy up to 6,000 National Guard troops to help secure the Southern U.S. border.[71] H.R. 4437 was passed by the House of Representatives on December 16, 2005 by a vote of 239 to 182. On May 25, 2006, The U.S. Senate approved by a vote of 62-36, its own White House-backed immigration reform bill that would grant some illegal immigrants a chance at citizenship and strengthen border security.
Some political commentators, such as CNN's Lou Dobbs, criticized the boycott for its promotion by groups such as the radical protest organization ANSWER, (Act Now to Stop War and End Racism). Dobbs also suggested that the choice of May Day betrays a communist affiliation on the part of the organizers, although May Day is part of the whole of the socialist tradition and not only of the later communist movement.

He instructed them to go to school, but we just learned from the school district that about 72,000 students from grades 6 through 12 did not go to school today, just a tremendous turnout..
In Mexico, meanwhile, instead of calling it "A Day Without Immigrants," organizers are calling similar protests there "A Day Without Gringos." Protesters are boycotting, get this, Wal-Mart, McDonald's and hundreds of other U.S. companies. Organizers say it's a show of solidarity for Mexican migrants working here in the United States... this rally, which really packed Union Square, heading down south to culminate at Foley Square

After the rally, protesters marched from Union Square down Broadway to Foley Square near City Hall Park where they were joined by other immigration advocates and some political leaders.
On September 5, 1882, in the first Labor Day celebration, a crowd of at least 10,000 workers paraded up Broadway and past the reviewing stand at Union Square. Union Square is, and was, a frequent gathering point for radicals of all stripes to make speeches or demonstrate.

...For nearly a week the Obama administration said virtually nothing about the disaster—besides reiterating that the “incident,” as Obama called it, would in no way lessen its support for the lifting of a moratorium on offshore drilling up and down the Atlantic Coast. Two days after the explosion, when the fate of the missing 11 men was still unknown, a reporter asked White House Press Secretary Robert Gibbs if Obama had yet “reached out to anyone in Louisiana over the oil rig explosion.” Gibbs responded, “Let me check on that. I don’t believe so.” The next day, Gibbs told reporters, “In all honesty I doubt this is the first accident that has happened and I doubt it will be the last.”

Finally Friday morning, senior Obama advisor David Axelrod admitted that the oil spill was a disaster that might temporarily delay further seabed oil exploration. Later in the day, Obama told a Rose Garden press conference that he had ordered Secretary of the Interior Ken Salazar to report to him within 30 days if any new safeguards are needed for deap sea oil rigs. Obama’s statement was “a largely symbolic gesture,” according to the Associated Press, since “no new leases are scheduled for the coming months.” Its transparent purpose was to protect Obama’s “planned expansion of offshore drilling,” according to the AP.
Friday, the Obama administration dispatched two air force planes and a number of warships to assist in containing the slick, and Louisiana Governor Bobbie Jindal requested a call-up of about 6,000 National Guard soldiers...
The parallels with Hurricane Katrina are striking. As that massive storm system approached the Gulf Coast in 2005, the Bush administration could not be roused to take elementary steps to assist area residents. Then, after Katrina struck, a stunned nation watched on television as desperate residents begged for relief. The Gulf Coast has never recovered from Katrina, and now some experts have predicted that the Deepwater Horizon spill could prove more economically devastating.

The Wall Street Journal wrote of “a growing sense among many in Louisiana that the government failed them again, just as it did during Hurricane Katrina five years ago.”

Why BP and the federal government did not take immediate precautions to cordon off the explosion area in the immediate aftermath of the explosion is just one of many questions that have emerged.... the Obama administration buckled before BP and oil industry pressure, failing to implement new safety and environmental regulations under consideration last fall. A BP executive wrote a letter to the administration stating that self-regulation was adequate. Among the regulations BP and other oil concerns were able to block was the inclusion on all oil rigs of a device called an acoustic switch—commonly used in other oil-producing nations—that sends impulses through the water that can trigger an underwater valve to shut down the well in the event of a blowback. BP found the costs of these units, about $500,000, excessive.
The oil giant reported $5.598 billion in profits for the first three months of 2010.

BP Is Criticized Over Oil Spill, but U.S. Missed Chances to Act
“Here you have the company responsible for the accident leading the response to the crisis,” said Tyson Slocum, director of Public Citizen’s Energy Program. “There is a problem here, and the consequence is clear.”
Officials in the Obama administration began for the first time Friday to publicly chastise BP America for its handling of the spreading oil gusher in the Gulf of Mexico, calling the oil company’s current resources inadequate to stop what is unfolding into an environmental catastrophe.... a review of the response suggests it may be too simplistic to place all the blame on the oil company. The federal government also had opportunities to move more quickly, but did not do so while it waited for a resolution to the spreading spill from BP, which was leasing the drilling rig that exploded in flames on April 20 and sank two days later. Eleven workers are missing and presumed dead.
The Department of Homeland Security waited until Thursday to declare that the incident was “a spill of national significance,” and then set up a second command center in Mobile. The actions came only after the estimate of the size of the spill was increased fivefold to 5,000 barrels a day.
Officials from BP and the federal government have repeatedly said they had prepared for the worst, even though a plan filed last year with the government said it was highly unlikely that a spill or leak would ever result from the Deep Horizon rig...

Whistleblower: BP Risks More Massive Catastrophes in Gulf

British Petroleum (BP) claims the oil conglomerate broke federal laws and violated its own internal procedures by failing to maintain crucial safety and engineering documents related to one of the firms other deepwater production projects in the Gulf of Mexico, according to internal emails and other documents obtained by Truthout. The whistleblower, whose name has been withheld at the person's request because the whistleblower still works in the oil industry and fears retaliation, first raised concerns about safety issues related to BP Atlantis, the world's largest and deepest semi-submersible oil and natural gas platform, located about 200 miles south of New Orleans, in November 2008...
Whether it's multiple oil spills that emanated from BP's Prudhoe Bay operations in Alaska's North Slope or the March 2005 explosion at the company's Texas refinery that killed 15 employees and injured 170 people, BP has consistently put profits ahead of safety....
Department of the Interior's Minerals Management Service (MMS) regulates offshore drilling practices... During two visits to the Atlantis drilling platform last August and September, MMS inspectors reviewed BP's blowout preventer records. Food & Water Watch said they believe MMS inspectors reviewed the test records and failed to look into the whistleblower's charges that engineering documents were missing. The blowout preventer, however, is an issue at the center of the Deepwater Horizon spill.
An MMS spokesperson did not return calls for comment.
Last October, Food & Water Watch filed a Freedom of Information Act (FOIA) request for expedited processing, seeking documents from MMS that indicate BP "has in its possession a complete and accurate set of 'as built' drawings ... for its entire Atlantis Project, including the subsea sector." "As-built" means lead engineers on a specific project have to make sure updated technical documents match the "as-built" condition of equipment before its used.
MMS denied the FOIA request."MMS does not agree with your assessment of the potential for imminent danger to individuals or the environment, for which you premise your argument [for expedited response]. After a thorough review of these allegations, the MMS, with concurrence of the Solicitor's Office, concludes your claims are not supported by the facts or the law," the agency said in its October 30, 2009, response letter. In response, MMS said that although some of its regulatory requirements governing offshore oil and gas operations do require "as built" drawings, they need not be complete or accurate and, furthermore, are irrelevant to a hazard analysis BP was required to complete... documentation of the Atlantis project ... and found them to be unsubstantiated."...
